Ex-Subway pitchman Fogle gets more than 15 years in prison

INDIANAPOLIS (AP) — The latest on the sentencing of former Subway spokesman Jared Fogle for sex crimes (all times local):

    1 p.m.

A judge has sentenced former Subway pitchman Jared Fogle to 15 years and eight months in prison for trading in child pornography and having sex with underage prostitutes.

U.S. District Judge Tanya Walton Pratt sentenced Fogle on Thursday after he pleaded guilty to one count each of travelling to engage in illicit sexual conduct with a minor and distribution and receipt of child pornography.

Fogle agreed to the plea deal in August after authorities raided his suburban Indianapolis home in July.

Prosecutors sought a 12½-year sentence, while Fogle’s attorneys sought five years.

The 38-year-old Fogle admitted paying for sex with girls as young as 16 and receiving child pornography produced by his charitable foundation’s former director.

He also agreed pay his 14 victims $100,000 each in restitution.

    12:40 p.m.

Former Subway pitchman Jared Fogle told a judge that he regrets his actions that destroyed his career and his life and harmed his victims.

Fogle said Thursday at his sentencing hearing in Indianapolis that he can’t undo the past but will do everything he can to be a better man and father when he gets out of prison.

Fogle pleaded guilty to one count each of travelling to engage in illicit sexual conduct with a minor and distribution and receipt of child pornography.

In Fogle’s plea deal, his lawyers agreed not to seek a sentence of less than five years in prison and prosecutors agreed to recommend a sentence of no more than 12½ years behind bars.

But U.S. District Judge Tanya Walton Pratt could sentence Fogle to up to 50 years in prison.

A psychiatrist who analyzed Jared Fogle says he concluded that the former Subway pitchman suffers from hypersexuality, mild pedophilia, and alcohol abuse and dependency.

John Bradford, a professor at the University of Ottawa in Canada, testified by phone Thursday at Fogle’s sentencing hearing that Fogle appears to have had a compulsive eating disorder and that he began to develop hypersexuality shortly after losing weight.

Bradford says Fogle told him he had sex with minors age 16 and 17 and had “a fairly extensive history” of using prostitutes. He says Fogle told him he masturbated to fantasies about prepubescent girls, but that there’s no evidence he acted on them.

Fogle pleaded guilty to one count each of travelling to engage in illicit sexual conduct with a minor and distribution and receipt of child pornography.

    10:35 a.m.

Experts are testifying on behalf of Jared Fogle during the former Subway pitchman’s sentencing hearing on child pornography and sex crimes charges.

Defense attorneys say a forensic psychiatrist and a psychologist will testify during Thursday’s hearing before Fogle makes a statement.

Fogle’s attorneys have said in court documents that he suffers from hypersexuality and alcohol problems and is committed to receiving treatment for his medical conditions.

Before the sentencing portion began, Fogle pleaded guilty to one count each of travelling to engage in illicit sexual conduct with a minor and distribution and receipt of child pornography.

Prosecutors are seeking a 12½-year prison sentence, while Fogle’s attorneys have asked for five years behind bars.

    9:50 a.m.

Former Subway spokesman Jared Fogle has formally pleaded guilty to child pornography and sex crimes charges.

Fogle told the federal judge presiding over his change-of-plea and sentencing hearing Thursday that he understands the charges and possible sentences.

He then pleaded guilty to one count each of travelling to engage in illicit sexual conduct with a minor and distribution and receipt of child pornography.

Prosecutors want a 12½-year prison sentence, while Fogle’s attorneys have asked for five years.

    9:25 a.m.

Former Subway spokesman Jared Fogle has told a federal judge that he’s sticking with his decision to plead guilty to the child porn and sex crime charges that will likely be sending him to prison.

U.S. District Judge Tanya Walton Pratt asked the 38-year-old Fogle whether he understood the possible penalties and still wished to plead guilty. Fogle responded “Yes your honor, I do.”

Fogle stood with his defense attorneys before the judge Thursday morning inside the Indianapolis federal courthouse.

Fogle agreed in August to plead to one count each of travelling to engage in illicit sexual conduct with a minor and distribution and receipt of child pornography.

Prosecutors want a 12 ½-year sentence, while Fogle’s attorneys have asked for five years.

    9:10 a.m.

A hearing to decide how long former Subway pitchman Jared Fogle will spend in prison on child porn and sex crime charges has started.

The 38-year-old Fogle sat at the defense table with his attorneys before the hearing began Thursday morning in the Indianapolis federal courthouse. He didn’t say anything to reporters when he arrived at the courthouse wearing a dark suit and red tie.

Fogle could give a statement to U.S. District Judge Tanya Walton Pratt before she announces his sentence. He agreed in August to plead to one count each of travelling to engage in illicit sexual conduct with a minor and distribution and receipt of child pornography.

Prosecutors want a 12 ½-year sentence, while Fogle’s attorneys have asked for five years.

    8:15 a.m.

Former Subway pitchman Jared Fogle is at the federal courthouse where he’ll soon learn how much time he’ll spend in prison on child porn and sex crime charges.

Fogle walked into the courthouse in downtown Indianapolis about 8 a.m. Thursday. He didn’t say anything as he walked past reporters while wearing a dark suit and red tie.

U.S. District Judge Tanya Walton Pratt is scheduled to sentence Fogle Thursday after accepting his plea to one count each of travelling to engage in illicit sexual conduct with a minor and distribution and receipt of child pornography.

Fogle agreed in August to plead guilty following a July raid of his suburban Indianapolis home. The case destroyed his Subway career.
