SMETHPORT — A 19-year-old student at Port Allegany High School has been charged with selling a marijuana vape pen to an underage student at the school last month.
Zaeden Setzer of Main Street, Roulette, is charged with solicitation of minors to traffic drugs, a first-degree felony; delivery of a controlled substance and criminal use of a communication facility, both third-degree felonies; four counts of corruption of minors, first-degree misdemeanors; and possession of drug paraphernalia, a second-degree misdemeanor.
According to the criminal complaint, Setzer solicited a 14-year-old to deliver a marijuana vape pen to another juvenile, age 15, for the sum of $40.
On March 19, the district’s school resource officer was notified that a vape pen was found in the STEM Lab inside the high school. A teacher who had a class in the room had called the guidance counselor and said she detected the odor of marijuana coming from a 14-year-old female. The counselor and principal went to the room, which was vacated and searched. The vape pen was found, and was next to where a 15-year-old male had been sitting, the criminal complaint noted.
The vape pen was given to the officer. Shortly thereafter, a teacher came in with another vape pen that a student had found in the restroom. After speaking to the students, with parents present, the officer learned that the 14-year-old female had used it in the classroom, the complaint stated.
Setzer was brought in for an interview, but became belligerent, started shouting and swearing and left the building, the complaint stated.
Setzer was arraigned before District Judge Bill Todd and released on unsecured bail. He is scheduled for Central Court on Thursday.
