SMETHPORT — A man staying at the Midtowne Motel in Port Allegany is in McKean County Jail for allegedly having a stolen gun, and shooting it several times beside the motel.
Jose Carilla, 30, is charged with receiving stolen property, a second-degree felony; recklessly endangering another, a second-degree misdemeanor; disorderly conduct — unreasonable noise, and loitering and prowling at night, third-degree misdemeanors.
According to the criminal complaint, filed at District Judge Bill Todd’s office, at about 2 a.m. Saturday, police were called to the Midtowne for a report of shots fired, with witnesses saying the suspect ran into room 43. Witnesses told Port Allegany Borough Police that Carilla was seen outside at a white truck shortly after the shots were fired, and ran into the room with something in his hands. They said he came out shortly after, not carrying anything, and shut off the white truck, then returned to the room.
Officers searched the exterior of the building and found seven shell casings. They made contact with Carilla, with the motel manager assisting with translating, and searched the room, finding a gun under a chair cushion along with two live rounds. The pistol was empty, the complaint stated.
The serial number of the pistol was run, and had been reported stolen out of Toledo, Ohio, the complaint stated.
Carilla was arraigned before on-call District Judge David Engman and remanded to jail in lieu of $100,000 bail. He is scheduled for Central Court on Aug. 12.
