SMETHPORT — A Duke Center man was found guilty of several charges following a jury trial Monday and Tuesday related to the indecent assault of a child.
David Frederick, 39, has been convicted of charges of two counts of endangering the welfare of a child, and one count each of corruption of minors-sexual in nature, indecent assault of a victim less than 16 years old and one count of indecent assault with the victim’s consent, McKean County district attorney Ray Learn said Tuesday afternoon.
Frederick was found not guilty of the other charges he faced, according to Learn. Court records indicate the charges he was found not guilty of are as follows: rape by forcible compulsion, rape of a child, statutory sexual assault, involuntary deviate sexual intercourse, aggravated indecent assault of a child, aggravated indecent assault without consent, and two counts each of sexual assault and incest of a minor.
Court records from the time Frederick was arrested indicated that between June 2008 and July 2013, while Frederick was in a position of authority over a girl who was under the age of 13, he forced the child to have sex with him.
Frederick will be sentenced on July 17, said Learn.
A jury trial started at the end of March ended in a mistrial after the jury inadvertently witnessed Frederick being led in shackles during a recess in deliberations.
“We’re pleased the trial was completed,” Learn said on Tuesday.
The first trial for Frederick was scheduled for March 25-26. Jurors began deliberations the afternoon of March 26, then met the next morning, March 27, to continue deliberations.
One juror was excused the morning of March 27. It was during a break while an alternate juror was being summoned that the jury reportedly saw Frederick shackled. Frederick’s attorney, Jay Carr, called for the mistrial, arguing the sight could sway the jury.
