Homicide charges against a Byrnedale man accused in the stabbing death of a man at a Johnsonburg apartment were bound to Elk County Court.
On Aug. 17, Harvey L. Detterline III, 37, was jailed for the death of 29-year-old Richard Hicks.
A preliminary hearing was held Sept. 27 before District Judge James Martin, who bound all charges to the county-level court, court records indicate.
Detterline is charged with criminal homicide and aggravated assault, both first-degree felonies; aggravated assault, a second-degree felony; possession of an instrument of crime, a first-degree misdemeanor; and possession of drug paraphernalia, a misdemeanor.
According to the criminal complaint, at 11:33 p.m. Aug. 16, Johnsonburg Borough Police were dispatched to Duffy apartments for a report of a break-in. When police arrived, they received another call from dispatch saying someone died at the complex.
Behind the building, police found Detterline, who was wearing black pants and socks but no shirt or shoes; he had blood on his back. He approached the officer, put his hands behind his back, and allegedly said to the officer that he was going to state prison. Detterline told the officer he stabbed Hicks, the complaint stated.
Through further investigation, police determined Hicks had entered a second-floor window at an apartment where Detterline was. Police said Detterline went upstairs and confronted Hicks. During a subsequent physical altercation, Detterline stabbed Hicks in the upper torso, according to the criminal complaint. Hicks also had cuts on his palms and a cut on the lower left side of his abdomen.
Detterline remains incarcerated in Elk County Jail without bail. He is represented by St. Marys attorney George Daghir.
