SMETHPORT — A McKean County jury found a Kane man guilty of most of the charges against him stemming from allegations he pointed a loaded firearm at another man.
Shaine S. Miller, 34, appeared for a two-day trial before President Judge John Pavlock Thursday in McKean County Court.
The jury found Miller guilty of aggravated assault, a first-degree felony; terroristic threats, a first-degree misdemeanor; recklessly endangering another person and simple assault, second-degree misdemeanors; and disorderly conduct, a third-degree misdemeanor. Pavlock found Miller guilty of a summary count of harassment.
The jury acquitted Miller of three misdemeanor counts of recklessly endangering another person.
District Attorney Stephanie Vettenburg-Shaffer prosecuted the case, and Public Defender Philip Clabaugh represented Miller.
“The Commonwealth charged — and the jury found — that the defendant possessed and used a firearm to commit the above crimes during an exchange with a resident on Greeves Street in Kane,” Shaffer stated in a press release. “The use of the firearm in the commission of the crimes increases the sentencing options available to the Court when the defendant is sentenced.”
Miller will be sentenced at 1 p.m. Nov. 8.
When he was first charged, Miller faced allegations that on Oct. 14, 2017, in the area of Greeves and Welsh streets, he pointed a gun at Leroy D. Harlan Jr. in the presence of a woman and two children.
When police arrived on scene, they found two men arguing in front of an apartment building, and a Sig Sauer P250 9mm handgun was lying in the grass along Welsh Street. The gun was loaded with 15 rounds of 9mm Luger full metal jacket rounds, according to court records.
