Johnsonburg man charged with sexually assaulting woman at gunpoint

JOHNSONBURG — A Johnsonburg man is currently incarcerated in the Elk County Prison in lieu of $75,000 bail after he allegedly sexually assaulted a woman at gunpoint.

Christopher John Cherry, 46, has been charged in district court for an incident that allegedly occurred on Dec. 4.

An affidavit of probable cause outlining the charges was obtained from the office of Magisterial District Judge James L. Martin.

According to the affidavit, Cherry and a female were in a Ridgway home talking when Cherry allegedly went onto the second floor of the home and retrieved a handgun that was located in a bedroom.

Upon returning, Cherry allegedly loaded the weapon and told the victim “that he was going to kill her and then himself.”

Cherry then allegedly began to demand that the victim have sex with him, which she said that she did not want to do. Cherry then allegedly responded with “if you’re not having sex with me, you’re having sex with someone,” court records read.

According to the affidavit, Cherry was reportedly banging the gun off of the kitchen countertop during this conversation. Cherry instructed the victim to go into the bedroom, where he allegedly sexually assaulted her.

Cherry was later arrested and arraigned before Magisterial District Judge Mark S. Jacob.

Cherry has been charged with a felony charge of criminal attempt – rape; a felony charge of involuntary deviant sexual discourse; a felony charge of sexual assault; a felony charge of aggravated indecent assault; a felony charge of aggravated assault; a misdemeanor charge of indecent assault; a misdemeanor charge of simple assault; a misdemeanor charge of recklessly endangering another person; a misdemeanor charge of terroristic threats; and a summary offense of harassment.

Jacob set bail at $75,000 monetary, and unable to post bail, Cherry was confined in the Elk County Prison.

Cherry is scheduled to appear before Martin on Dec. 21 at 9:30 a.m. for a preliminary hearing.
