LEGAL NOTICE

NOTICE IS HEREBY GIVEN that the Norwich Township Supervisors will hold a special meeting on Tuesday, October 21, 2025, at 7:00 p.m. at the Norwich Township Office, 3853 West Valley Road, Smethport, Pennsylvania, for the purpose of acting on two Ordinances, taking action pertaining to the Township budget and general Township business, and any other matters that may come before the Supervisors.

NOTICE IS FURTHER GIVEN that the following Ordinances will be considered for adoption at the duly convened meeting to be held on Tuesday, October 21, 2025, at 7:00 p.m., at the Norwich Township office, 3853 West Valley Road, Smethport, Pennsylvania, by the Norwich Township supervisors. The title of the Ordinances and brief summaries thereof are as follows:

AN ORDINANCE REGULATING THE SITING, CONSTRUCTION, OPERATION AND RECOMMISSIONING OF SOLAR ENERGY FACILITIES AND BATTERY ENERGY STORAGE SYSTEMS (INCLUDING STANDALONE BESS)

This Ordinance establishes reasonable, evidence-based standards to protect public health, safety, welfare, property values, and natural resources; preserve rural character and scenic resources; avoid de facto exclusion of solar or storage by allowing compliant projects and agrivoltaics/dual-use designs; recognize standalone BESS as a principal use subject to protective standards; and ensure full decommissioning and restorative reclamation. This Ordinance further regulates the siting, design, construction, operation, maintenance,

decommissioning, and restoration of Utility-Scale Solar Energy Facilities and Battery Energy Storage Systems (BESS), whether integrated with solar or standalone and whether associated with any other generation source.

This Ordinance sets forth the permit requirement and permit application process; escrow requirements for peer review and monitoring, professional peer review and monitoring, and litigation defense and claims; design and installation requirements; setback and buffer requirements; standards for noise, low-frequency sound, and vibration; storm water, erosion, slope stability, and water resource protection requirements; glare, visual, and lighting mitigation requirements; fire protection and emergency response requirements including NFPA 855 and UL 9540/9540A compliance for BESS; signal and electromagnetic interference requirements; liability insurance requirements; decommissioning, restoration, and financial security requirements; property value protection and claims process requirements; environmental monitoring requirements; operational compliance and reporting requirements; military airspace and military coordination requirements; temporary structures and test equipment requirements; battery energy storage system (BESS) including standalone requirements; subdivision and land development restrictions; transfer of ownership or control requirements; and enforcement provisions, remedies, and penalties for violations of the Ordinance.

AN ORDINANCE REPEALING AND REPLACING ORDINANCE NO. 43, AN ORDINANCE REGULATING THE CONSTRUCTION, OPERATION AND DECOMMISSIONING OF WIND ENERGY

FACILITIES This Ordinance repeals Norwich Township Ordinance No. 43 in its entirety and adopts updated regulations governing the siting, permitting, construction, operation, monitoring, modification, and decommissioning of utility-scale wind energy facilities within Norwich Township. The Ordinance expands definitions and procedures; updates setbacks from property lines, occupied buildings, roads, wells, and public lands; establishes limits for audible noise and low-frequency sound and provides enforcement mechanisms; adds protective standards for water resources, stormwater, oil and gas infrastructure, and wildlife habitat; requires financial assurances for decommissioning, road restoration, and legal defense costs; provides procedures for inspections, complaint response, permit transfers, and term limits; strengthens decommissioning requirements and public-participation safeguards; and reaffirms the Township’s constitutional duties to protect public health, safety, welfare, and natural resources. All Ordinances or parts of Ordinances inconsistent herewith are repealed.
