By virtue of the within Writ of Execution issued out of the Court of Common Pleas of McKean County, Pennsylvania, No. 688 C.D. 2024 And to me directed, I will expose to Public Sale at the Sheriff’s Office, Smethport, Pennsylvania on Wednesday, April 30, A.D. 2025 at 10:15 a.m., E.D,S.T.:
All those certain pieces, parcels and lots of land situate, lying and being in the Borough of Kane, County of McKean and Commonwealth of Pennsylvania, part of Warrant 3210, bounded and described as follows: FIRST: BEGINNING at a point in the south line of Haines Street marking the northwest corner of land conveyed to John E. Hoover and wife by Anna H. Oliver, on February 6, 1952, and recorded in the Recorder of Deeds Office for McKean County, Pennsylvania, in Deed Book Vol. 322, Page 293&c; thence south seven degrees fifty-four minutes east one hundred two feet (S. 7º 54’ E. 102 ft.) to a post; thence south seventy degrees west forty feet (S. 70º W. 40 ft.) along land now or formerly of L.W. Dana; thence north seven degrees fifty-four minutes west (N. 7º 54’W.) along land now or formerly of Swan A. Bloomster to a point on the south line of Haines Street; thence by the south line of Haines Street north eighty-two degrees six minutes east about thirty-five feet (N. 82º 6’ E. 35 ft.) to a stone marking an angle in the south line of Haines Stret, said stone being two hundred twenty-two and one-half feet (222-1/2 ft.) west of the southwest corner of Welsh and Haines Streets; thence along the south line of said street five feet (5 ft.) to the place of beginning.
SECOND: BEGINNING at a point marking the southeast corner of land hereinabove described; thence south twenty degrees east forty-five feet (S. 20º E. 45 ft.) to a point in the north line of an alley which also marks the southwest corner of land conveyed to John E. Hoover and wife by Anna H. Oliver and husband, on February 6, 1952 and recorded in the Recorder of Deeds Office for McKean County, Pennsylvania, in Deed Book Vol. 322, Page 293&c; thence south seventy degrees west sixty-one feet (S. 70º W. 61 ft.) along the north line of said alley to land now or formerly of August Peterson; thence by said land north twenty degrees west forty-five feet (N. 20º W. 45 ft.) to a point on the southern boundary of land now or formerly of Bloomster; thence north seventy degrees east sixty-one (N. 70º E. 61 ft.) along the southern boundary of land now or formerly of Bloomster and of the hereinabove described parcel to the place of beginning.
THIRD: Being part of Lot. No. 50 Haines Street. BEGINNING at an iron rod in the north line of an alley, said point marking the southwest corner of premises conveyed by Ernest P. Lee, Sr. and Margaret L. Lee, husband and wife, to Ramon L. Swedenhjelm and Lucille M. Swedenhjelm, husband and wife, by deed dated October 25, 1994, and recorded in the office of the Recorder of Deeds for McKean County, Pennsylvania, in Record Book 201, Page 1106&c.; thence along the westerly line of said premises north twenty degrees west forty-five feet (N. 20º W. 45 ft.), more or less, to an iron rod marking the southeast corner of premises conveyed at Parcel First in deed from Gertrude Cochran Sanders, widow, to Ernest Lee and Margaret Lee, husband and wife, dated November 11, 1983, and recorded in the aforesaid Recorder’s Office, in Record Book 12, Page 240&c.; thence, parallel, with the north line of said alley, north seventy degrees east twenty-five feet (N. 70º E. 25 ft.) to a point; thence south twenty degrees east forty-five feet (S. 20º E. 45 ft.), more or less, to the north line of said alley; thence, by the north line of said alley, south seventy degrees west twenty-five feet (S. 70º W. 25 ft.) to the place of beginning.
FOURTH: BEGINNING at a point in the south line of Haines Street, said point marking the northeast corner of premises conveyed by Ernest Lee and Margaret Lee, husband wife, to Doug E. Walker and Aimee M. Walker, husband and wife, as tenants by the entireties, by deed dated September 8, 2003, and recorded in the office of the Recorder of Deeds for McKean County, Pennsylvania, on September 12, 2003, in Record Book 438, Page 947&c., and also marking the northwest corner of premises conveyed at Parcel First by Gertrude Cochran Sanders, widow, to Ernest Lee and Margaret Lee, husband and wife, by deed dated November 11, 1983, and recorded in the aforesaid Recorder’s Office on November 15, 1983, in Record Book 12, Page 240&c.; thence along the east line of said premises conveyed to Walker, being also the west line of said premises conveyed to Lee, south seven degrees fifty-four degrees east one hundred two feet (S. 7º 54’ E. 102 ft.), more or less, to an iron rod marking the southeast corner of said premises conveyed to Walker; being also the west line of said premises conveyed to Lee, said point also being in the north line of Parcel Second of deed from Sanders to Lee as aforesaid; thence along the south line of said premises conveyed to Walker, south seventy degrees west twenty-one feet (S. 70º W. 21 ft.) to an iron rod, said rod marking the northwest corner of premises conveyed at Parcel Second of deed from Sanders to Lee as aforesaid; thence northerly in a straight line to a point in the south line of Haines Street, said point being south eighty-two degrees six minutes west eighteen feet (S. 82º 6’ W. 18 ft.) from the place of beginning; thence along the south line of Haines Street north eighty-two degrees six minutes east eighteen feet (N. 82º 6’ E. 18 ft.) to the place of beginning.
TOGETHER with all improvements located thereon.
BEING THE SAME PREMISES conveyed to David P. Peterson and Marily I. McMahon as joint tenants with right of survivorship by virtue of a Deed dated February 13, 2015 and recorded on February 20, 2015 in McKean County Record Book 810, page 926.
SEIZED AND TAKEN IN EXECUTION and will be sold as the property of David P. Peterson and Marily I. McMahon at the suit of Hamlin Bank and Trust Company
Notice is given to all parties in interest and claimants that all claims to the property must be filed with the Sheriff before the sale and claims to the proceeds from the sale before distribution. A Sheriff’s Schedule of Distribution will be filed in the Sheriff’s Office on April 30, 2025 and distribution of the sales proceeds will be made in accordance with the schedule unless exceptions are filed within ten days.
