COUDERSPORT — Coudersport based state police were called to 278 Ives Hollow Road in Galeton on April 1 for a report of theft.
Cory Shifflett, 50, reported that Dustin Butler, 24, owner of Black Bear Construction, had been contracted to replace the roof at that residence. Shifflett stated the contract was accepted and paid in the amount of $6,200, and that the company had received payment. According to Shifflett, he attempted for nine months to have Butler fulfill the agreement, and after a period of time, he requested his money back. Butler stopped responding to Shifflett and did not return any funds.
Butler is charged with false statement to induce an agreement for home improvement service, felony of the third degree; receives advance payment for services and fails to perform home improvement agreement, felony of third degree; theft by unlawful taking, felony of the third degree; theft by deception — false impression, felony of the third degree; theft by deception — failure to correct a false impression, felony of the third degree; and receiving stolen property, felony of the third degree.
