    FCI-McKean inmate sentenced to state prison for drug charge

    SMETHPORT — A Puerto Rican national was sentenced Tuesday in McKean County Court to a lengthy term in state prison for possessing drugs that were smuggled in to him while he was incarcerated in the Federal Correctional Institution at McKean.

    Josean Reyes-Pagan, 36, was sentenced to 5 years to 10 years in state prison for possession of contraband by an inmate, conspiracy and possession with intent to deliver a controlled substance. His sentence is to run consecutive to his current federal sentence.

    District Attorney Stephanie Vettenburg-Shaffer prosecuted the case, while Pagan was represented by attorney Robert Kinnear.

    The sentence was imposed by Senior Judge William Morgan.

    Court records filed at the time Pagan was first arrested indicated that on June 19, prison personnel observed a visitor, Jennifer Oliva, 20, of Greensboro, N.C., attempt to deliver a controlled substance to Pagan — who was an FCI-McKean inmate at the time — during the prison’s visiting hours. Security footage showed her falling intentionally into his lap, then he could be seen putting items in his pant pocket and socks or shoes.

    When he was confronted, prison personnel found that he had 34 packets of packaged Suboxone strips on him, court records stated.

    For her part in the incident, Oliva was sentenced to one to two years in state prison for allegations that she brought her young child with her when she delivered suboxone to an inmate at FCI-McKean.

    Pagan was serving time in federal prison for his part in a huge drug trafficking ring in San Juan, Puerto Rico, where 114 were charged with possessing with intent to deliver more than one kilogram of heroin; five kilos of cocaine; 1,000 kilos of marijuana; and Percocet and Xanax, all within 1,000 feet of a public school.

    Also on Tuesday, John F. Vail, 19, of Olean, N.Y., was sentenced to 18 months of probation for a charge of unauthorized use of a motor vehicle.

    According to Assistant District Attorney Ashley Shade, on Dec. 1, Vail operated a Ford F-150 belonging to someone else.

    Court records filed at the time of Vail’s arrest indicated that he was pulled over by Ohio State Patrol, who found that he was driving a truck from Zook Motors in Kane, along with two juveniles. Vail was initially taken to Noble County Jail in Caldwell, Ohio, when he was found. Charges filed against him in Ohio for the incident were withdrawn so prosecution of criminal charges in Pennsylvania could move forward.

    Robert Guest, 35, of Kane, was sentenced to 15 days to 12 months incarceration for a charge of simple assault. On Jan. 28, Guest caused a woman to get a black eye, Shade said.

    Jeremy Wike, 34, of Bradford, will serve 12 months of probation for a count of simple assault. On Jan. 7, 2016, Wike was in a mutual fight with his paramour, said Shaffer.

    Chris Schatz, 46, of Kersey, will serve 12 months of probation for possessing a glass smoking pipe.

    Amanda Renner, 35, of Port Allegany, was sentenced to 6 months intermediate punishment with the first 45 days on house arrest, 12 month license suspension, for driving under the influence of alcohol.

    James Farnham, 34, of Lewis Run, was sentenced to 6 months intermediate punishment with the first 30 days on house arrest, 12 month license suspension, for DUI.

    Abby Winsor, 39, of Bradford, was sentenced to 60 days to 18 months in the McKean County Jail, 18 months concurrent probation with 32 days credit and restitution to Walmart and Dollar General. Charges include retail theft, hindering apprehension, and operating a vehicle without an ignition interlock.
