Sex offender’s request for hospice release denied
A Mount Jewett man convicted of sex crimes against two children has been denied release into hospice care for terminal stage 3 lung cancer.
The Pennsylvania Superior Court denied the request for release from Kevin Brown, 62, who had been sentenced in 2022 to 12 to 24 years in state prison plus three years of consecutive probation, following conviction by a jury, said District Attorney Stephanie Vettenburg-Shaffer.
Brown was determined to be a sexually violent predator, and a lifetime registrant for the Megan’s Law website.
In November 2024, Brown filed an emergency petition for release for hospice care to his wife’s home. McKean County Judge Pavlock denied the request, and Brown appealed the denial of his motion without first holding a hearing. Shaffer explained.
In his appeal, Brown included information from UPMC Family Hospice, which noted that he had declined anything but comfort care.
The Superior Court affirmed Pavlock’s denial without a hearing, noting the judge found that release of Brown to the residence of his wife where the crimes occurred would pose an undue risk of escape or danger to the community. No hearing was necessary for the court to decide the matter. The Superior Court agreed with the judge’s findings, according to Shaffer.
Brown had been convicted of statutory sexual assault – 11 or more years older than the victim, involuntary deviate sexual intercourse on a victim younger than 13, sexual assault, corruption of minors as a course of conduct, corruption of minors and two counts of indecent assault (victim younger than 13).
The case was investigated by Trooper Neil Ginther of Pennsylvania State Police at Lewis Run. The crimes occurred between Sept. 24, 2016, and Aug. 14, 2019, in Mount Jewett.
