Board denies appeal for Interstate Parkway residence

The Bradford Board of Health denied an appeal for an Interstate Parkway home Tuesday when no one showed up to argue for it, and no work had been done as promised.
In a brief hearing Tuesday, the board was to consider the continuation of an appeal hearing for 18 Interstate Parkway, owned by Gary Dioguardi. At a January hearing regarding the property, Steve Deitz, who plans to buy the property, had spoken to the board as well.
Neither man was at Tuesday’s hearing.
Health director Brandon Plowman produced a receipt for certified mail he had sent Dietz regarding conditional issues still existing, as well as the date for the continuation of the hearing.
Plowman had photos he had taken Tuesday showing code violations at the property Special counsel Tyler Hannah noted several problems the board had raised at its January hearing, and asked Plowman whether they had been corrected.
‘Is there a dead ash tree on the property?’ Hannah asked.
‘Yes,’ Plowman said. It was ordered to be removed and hasn’t been.

“The overhead garage door, the windows are broken out of it,” Plowman said, adding the entire structure is in poor condition. Rubbish and garbage remain in the yard as well.
Hannah asked if it appeared there were any attempts made to remedy the code violations.
Plowman replied, “I do not see where Mr. Dioguardi has made any attempts to remedy these conditions.”
Board President Fred Proper asked if anyone is living at the residence. Plowman said not that he could tell. He asked if the written timeline of work to be completed had been received by the health department; Plowman said no.
Board member Kris Goll asked to add high grass to the violations for the property.
Board member Tom Riel made a motion to deny the appeal; it was approved.
The public nuisance status was affirmed.
