A 9-year-old Kane male was allegedly involved in arson for causing a fire at a Maple Street residence Saturday, according to Lewis Run-based state police.
The state police fire marshal was called in to assist Kane Volunteer Fire Department with determining the origin and cause of a fire at a Maple Street residence at 9:45 a.m. Saturday. A joint investigation along with Kane Borough Police determined a juvenile was responsible for causing the fire.
No injuries occurred and damage to the property was $100, police said.
The victim is listed as a 35-year-old female from Kane.
Police said the investigation is ongoing.
Trooper Andrew Eliason, investigating officer, said the child was not arrested. McKean County District Attorney Stephanie Vettenburg-Shaffer explained, “In Pennsylvania, criminal responsibility starts at the age of 10.”
If a child age 10 or older should have charges filed against them, it would be through a juvenile petition rather than a criminal complaint. Should the child be found guilty, rather than a conviction, the case for a juvenile would be adjudicated.
“The juvenile act differs from the adult criminal system in that the focus is on treatment for the juvenile whereas the adult system has three goals — punishment, deterrence and rehabilitation,” Shaffer said.
When a child is younger than 10, Shaffer said, “He can’t be charged at all.”
In that case, the child can be referred to Children and Youth Services.
“In the CYS realm, the focus is on a child deemed to be a ‘dependent child,’” she said, spelling out 10 cases in which a child would be qualified as such. One of those is “has committed a delinquent act or crime, other than a summary offense, while under the age of 10 years.”
