SMETHPORT — An Eldred man was sentenced Wednesday in McKean County Court to 27 to 72 months in state prison for crimes against a minor child.
Phillip Haun Jr., 30, had been convicted by a jury in August of two counts of endangering the welfare of a child, terroristic threats, simple assault by physical menace and resisting arrest.
Visiting Judge Robert L. Boyer imposed the sentence, and found Haun not eligible for any early parole programs such as boot camp. Haun was ordered to have no contact with the victim or the victim’s immediate family and to undergo mental health treatment, according to District Attorney Stephanie Vettenburg-Shaffer.
She said that at trial, testimony included statements that Haun used two different firearms in the commission of the crimes with which he threatened the child. The child described the crimes and gave a description of the guns used by the defendant to school personnel and his description was used by police to obtain a search warrant to seize these guns. Trooper Neil Ginther and Trooper Kevin Shaffer, along with other members of the Pennsylvania State Police-Lewis Run barracks, executed the search warrant when they took Haun into custody and the guns were found in Haun’s residence and seized by troopers.
Shaffer explained that the Pennsylvania sentencing guidelines permit the court to apply an enhancement for any crime in which a deadly weapon was possessed or used during the crime(s). The enhancement increases the range of sentence that can be imposed and was used in this case.
