An Olean, N.Y., man was convicted of drug charges Wednesday following a two-day trial in McKean County Court.
Karl Ginnery, 37, was convicted of possession with intent to deliver methamphetamine, three counts of possession of a controlled substance for methamphetamine, marijuana and benzodiazepine pills; two counts of possession of drug paraphernalia and possessing an instrument of crime.
He was found not guilty of an additional count of possession of drug paraphernalia and possession of marijuana and benzodiazepine pills with intent to deliver.
At 10 a.m. on Sept. 3, 2020, a Bradford City officer observed a car occupied by a female driver and a male passenger who appeared nervous when they saw the officer. After observing the car more, the officer looked up the vehicle’s registered owner, and found the registered owner had 14 warrants for his arrest.
The officer noticed the car had a New York State inspection sticker but a Pennsylvania registration, so he pulled the car over, according to court records.
Neither the driver — Megan N. Sena of Roulette — nor the passenger — Ginnery — was the car’s owner. Sena told the officer right away that she borrowed the car from a different male, the complaint indicated.
The officer noticed drug paraphernalia in the vehicle, and searched it. According to the complaint, officers found the following items: two plastic containers and a plastic bag with methamphetamine in them, a plastic bag with three clonazepam pills, a plastic bag of marijuana, a buprenorphine/naloxone strip, a blunt, a Ziploc bag of cotton swabs, nine new syringes, straws with residue, a prescription bottle of 30 mirtazapine pills, a cellophane bag with 19 fluoxetine pills, two butane burners, $19 cash, a blue scale with white residue, a loaded syringe, assorted Ziploc bags and a glass pipe.
The complaint indicated that Ginnery claimed ownership of all the items that were seized and told police that he asked Sena to drive him to meet a friend. He said he was going to distribute the seized narcotics to the friend and discuss the possibility of Ginnery transporting larger quantities of narcotics to the Bradford area, according to court records.
The case was investigated by Officer Joshua Frederoski of the City of Bradford Police. District Attorney Stephanie L. Vettenburg-Shaffer prosecuted the case on behalf of the Commonwealth. Sentencing was scheduled by President Judge John Pavlock, who presided over the trial, for Feb. 10.
