A Bradford man is in McKean County Jail after parole agents allegedly found cocaine in his home that was packaged for sale.
James P. Munday, 33, of 90 Winter St., was arraigned Wednesday night before District Judge David Engman on charges of possession with the intent to deliver a controlled substance, a felony; possession of a controlled substance, possession of drug paraphernalia and possession of a small amount of marijuana for personal use, all misdemeanors.
The criminal complaint states that at 11:05 a.m. Wednesday, two agents with Pennsylvania State Parole went to Munday’s residence because Munday is on state parole.
One agent entered the home with permission and saw alcohol, which is a violation of Munday’s parole conditions. Munday also admitted that he had used marijuana, according to the complaint.
“Munday was acting nervous not sitting still and became different than he was and he kept trying to pick up a backpack,” the complaint stated. He continued to act as though something was wrong, so the agent called the second agent to the doorway.
The first agent began to search the residence, and when he touched another backpack that was in the home, Munday ran, shouldering the other agent out of the way to exit through the door, court records stated. A foot chase ensued, with Munday falling several times as he crossed Winter street and through yards toward Summer Street. They tried to use a Taser on him, but the Taser failed.
Munday was tackled to the ground, and an agent was able to handcuff him even though he kept struggling, the complaint indicated.
According to court records, inside the backpack, agents found a larger bag contained suspected cocaine, empty baggies, a box of sandwich bags and a digital scale. A subsequent search warrant executed at the home yielded about 1 ounce of cocaine split into three baggies, boxes of sandwich bags, scales, straws, $2,970 in cash, marijuana residue, a .22 clip with ammunition, a marijuana grinder and additional paraphernalia.
Munday is in McKean County Jail in lieu of $40,000 bail. A preliminary hearing is set for Wednesday.
Also on Wednesday, Munday has a preliminary hearing scheduled for a previous DUI-controlled substance case for allegations stemming from Feb. 16 in Foster Township.
