Bradford man facing assault, resisting arrest allegations
A Bradford man is facing allegations of assault and resisting arrest after an incident Sunday morning.
Daniel E. Baney, 73, was arraigned Sunday before District Judge Richard Luther on two counts of terroristic threats, first-degree misdemeanor; two counts of simple assault and one of resisting arrest, second-degree misdemeanors; and two counts of summary harassment.
According to the criminal complaint, at 7:51 a.m. Sunday, Foster Township Police responded to a Bolivar Drive residence for a report of an out-of-control, intoxicated man — Baney.
An officer arrived to find Baney sitting on the floor yelling at relatives, and a relative told an officer that Baney had been drinking since 6:30 a.m. The relative showed the officer an empty bottle of brandy and another half-empty bottle.
Baney threatened to punch the officer in the mouth, and he said he was going to get his loaded gun from upstairs “and blow this Officer’s brains out,” the complaint stated.
The officer was able to get Baney to sit in a chair until a second officer arrived.
Baney grabbed a female’s hand and tried to strike her, and the officer had to pry Baney’s fingers from her, the complaint alleged.
When the other officer arrived, Baney allegedly tried to strike him and threatened to shoot him. The second officer and two victims started to walk in the direction of the stairs to gather any firearms, and Baney struck the officer and tried to strike the other two, according to court records. He threatened to shoot the two victims, too.
While the first officer was putting handcuffs on Baney, Baney kicked him in the groin area and tried to strike him in the face, the complaint alleged.
Both officers worked together to get Baney into a patrol vehicle, and Baney continued threatening to shoot the officers during the drive to the Bradford police station, court records stated. At the station, three officers worked together to put Baney in a cell.
Baney is in McKean County Jail in lieu of $50,000 bail. A preliminary hearing is set for Wednesday.

Felony charges against Port Allegany man dropped
Felony charges against a Port Allegany man have been dropped, but he pleaded guilty to two misdemeanors Monday.
Steven D. Hartzell II, 40, pleaded guilty before District Judge William Todd to charges of simple assault and harassment, third-degree misdemeanors, court records indicate.
Meanwhile, felony charges of burglary and criminal trespassing, along with two summary charges, were withdrawn.
Court records filed in October alleged that on Oct. 18 Hartzell went to a woman’s residence, took her phone and would not let her leave. Then, on Oct. 20, Hartzell allegedly went back to the home, began yelling at her and another male, tried to punch the male and tried to physically harm the woman.
The case is now closed.
