Waynesburg man pleads to 3 DUIs, fleeing from police

SMETHPORT — A Waynesburg man pleaded guilty Thursday in McKean County Court to allegations he had three DUIs in a two-month period, and when police tried to pull him over during the third DUI, he fled.

Robert E. Denman Jr., 39, entered the guilty plea to charges in three cases: in one, he’s charged with fleeing or attempting to elude an officer, DUI-general impairment and a summary charge; in the second, with DUI-general impairment and a summary charge; and in the third with DUI-alcohol.

According to Assistant District Attorney Ashley Shade, Denman had DUIs on Oct. 26 and Oct. 27. Then, on Dec. 15, Denman was removed from Busty Heart’s Place because he was being loud while under the influence of alcohol; while he was driving under the influence, a police officer tried to pull him over, but he refused visible and audible signals to stop his vehicle. Denman will be sentenced Feb. 13.

Also in court, Mark L. Chittester, 26, of Johnsonburg, pleaded guilty to a charge of possession with the intent to deliver a controlled substance. Shade said that on Aug. 14, 2018, Chittester possessed with the intent to deliver about 2.23 grams of heroin. He will be sentenced Feb. 27.

Steven M. Holly, 43, of Lewis Run, pleaded guilty to charges in two cases. In one he entered a plea to a charge of simple assault, and in the other to a charge of possession of a firearm prohibited. According to District Attorney Stephanie Vettenburg-Shaffer, on Nov. 7, Holly, who is not allowed to possess a firearm due to a prior felony drug conviction, did possess a firearm; then, on Nov. 25, while an inmate at McKean County Jail, Holly hurt a fellow inmate, who suffered a broken jaw. Holly will be sentenced Feb. 13.

Tyler W. Travis, 26, of Bradford, pleaded guilty to charges in two cases. In one he entered a plea to a summary charge of criminal mischief, and in the other to a charge of flight to avoid apprehension. According to Shade, on June 19, Travis punctured three tires with a knife, and on Oct. 19, Travis, who was aware of an outstanding warrant for him, fled into a wooded area when he was approached by a police officer. Travis will be sentenced Feb. 27.

Derek J. Steck, 24, of Bradford, pleaded guilty to charges of flight to avoid apprehension and possession of drug paraphernalia. Between Sept. 27 and Oct. 26, Steck was on the run, evading arrest after fleeing from a halfway house in Erie, and on Oct. 26 he was found to be in possession of a glass marijuna smoking pipe, said Assistant District Attorney Bridget Murphy. Steck will be sentenced Feb. 13.

Trevor Elder, 26, of Smethport, pleaded guilty to charges of flight to avoid apprehension and possession of drug paraphernalia. Murphy said that on Oct. 25, Elder escaped from an addiction treatment center in Philadelphia and traveled to Bradford knowing he had an active warrant for him; he also possessed a small box that had been used to hold a controlled substance. He will be sentenced Feb. 13.

Faith A. Marvin, 23, of Titusville, pleaded guilty to a charge of interference with the custody of children. Marvin took a child under the age of 18 from the child’s custodian; Marvin is the mother and had partial custody rights, but the father has sole physical custody and Marvin did not return the child, Shaffer explained. Marvin will be sentenced Feb. 27.

Michael J. Pope, 36, of Bradford, will serve 90 days to five years of incarceration for charges in three cases. He’s charged in one with DUI-general impairment, in the second with simple assault and in the third with summary harassment.

Jamie K. Defilippo, 27, of Bradford, pleaded guilty to charges of access device fraud and receiving stolen property. According to Murphy, between Sept. 26 and Dec. 8 in 2018, Defilippo retained a stolen Discover credit card; Defilippo faces $816.20 in restitution for use of the card. She will be sentenced Feb. 27.

Christopher A. Barber, 31, of Portville, N.Y., pleaded guilty to charges in two cases. In one case, he entered the plea to a charge of summary harassment, and in the second to charges of possession of a controlled substance, DUI-controlled substance and summary charges. According to Shaffer, on July 24, Barber drove under the influence of methamphetamine, and on March 24, Barber struck another man. Barber will be sentenced Feb. 27.

Jennifer M. Paulik, 45, of Bradford, will serve six months in the Intermediate Punishment Program for a charge of DUI-general impairment and a summary charge.

Simon E. Albright, 22, of Bradford, will serve one year of probation for a charge of possession of drug paraphernalia.

The following people were accepted into the Accelerated Rehabilitative Disposition Program: Melanie R. Stone, 45, of Bradford, for DUI-general impairment and possession of marijuana and drug paraphernalia; and Lloyd C. Holden, 56, of Gifford, Anita R. Danielson, 48, of Mount Jewett, and Dorothy J. Walton, 59, of Smethport, all for DUI-alcohol.
