Rixford woman to serve state prison for firearms charge

SMETHPORT — A Rixford woman, who was accused of conspiring with then-husband William Tipton to allow him to possess a firearm illegally, was sentenced Thursday in McKean County Court to a term in state prison.

Julie A. Tipton, 37, will serve 22 to 44 months in state prison with credit for one day of time served for a charge of conspiracy-possession of a firearm prohibited. She was found guilty at a jury trial on Feb. 12.

Her then-husband, William Tipton, pleaded guilty in May to charges of possession of a firearm prohibited and endangering the welfare of a child, and he is serving five to 10 years in state prison for the conviction. He allowed a child to shoot the handgun outside his home while police were there.

Tipton’s attorney, Christopher Martini, made an oral motion for extraordinary relief, seeking relief such as a new trial. President Judge John Pavlock denied the request.

Prior to sentencing, Pavlock was given a letter from Julie Tipton, which he read silently. When he finished, he summed it up by saying the letter “blames everyone else for everything.” After describing further the discrepancies between the trial testimony and her letter, Pavlock said, “The defendant is still not taking responsibility for this.”

Also in court, Andrew J. Beck, 28, of Smethport, will serve one to four years in state prison with credit for 138 days of time served for charges in two cases. He’s charged in one case with terroristic threats, simple assault and recklessly endangering another person and in the second with possession of a controlled substance and possession of drug paraphernalia. Court records filed at the time Beck was first charged in the assault case indicate he was accused of assaulting a woman over a two-day period, threatening to kill her and nearly striking two people with his car.

Travis J. Blackman, 36, of Port Allegany, will serve five months in the Intermediate Punishment Program, for charges of possession of a controlled substance, DUI-controlled substance and summary charges.

Javan C. Lapp, 37, of Cyclone, will serve five years in the Intermediate Punishment Program for charges of DUI-alcohol and summary charges.

Shayne A. Sage, 22, of Emporium, will serve 30 days to 18 months in McKean County Jail with credit for 28 days of time served. On March 7, Sage pleaded guilty to a charge of terroristic threats for allegations that between Feb. 14-15, Sage communicated to someone that if he did not see his children soon, he would go on a killing spree.

Merry B. Reynolds, 50, of Lewis Run, will serve five months to one year in McKean County Jail and pay $194 in restitution for charges of buying/exchanging federal food stamps and access device fraud. On Jan. 31, Reynolds pleaded guilty to allegations that on Aug. 8, 2017, she used an Electronic Benefit Transfer (EBT) card belonging to another person — with permission from the card user — to purchase $194 of consumable goods in exchange for $100 cash.

Devin J. Ortz, 18, of Bradford, will serve 18 months of probation for a charge of resisting arrest and a summary charge. Ortz pleaded guilty Feb. 14 to allegations that on Nov. 23, he resisted arrest, refusing to be handcuffed. He told Bradford City Police he would not go anywhere, and he shoved an officer.

Karlie A. Ryan, 23, of Oil City, will serve 11 ½ months of probation for a charge of retail theft.

On March 7, Ryan pleaded guilty to allegations that on Dec. 8, 2017, she took a two-pack of air duster worth $7.63 from Walmart.

Daniel P. Davidson, 39, of Kane, will serve 75 days in McKean County Jail for a charge of DUI-general impairment and summary charges.

Amy J. Simes, 40, of Bradford, will serve three days to six months of incarceration for charges of DUI-controlled substance and summary charge.

Phillip A. Murray, 41, of Smethport, will serve one year in the Intermediate Punishment Program for two separate cases. He’s charged with DUI-alcohol and summary charges in both cases.

David C. Thompson, 40, of Bradford, will serve six months in the Intermediate Punishment Program for charges of DUI-alcohol and a summary charge.

Michael E. Trombley, 56, of Port Allegany, will serve six months in the Intermediate Punishment Program for DUI-alcohol and a summary charge.
