    Man receives prison term for drug delivery allegations

    SMETHPORT — A man was sentenced Thursday in McKean County Court to time in state prison for a crack cocaine sale in November.

    Joseph J. Cole, 45, will serve 15 to 30 months in state prison with credit for 95 days of time served for charges of possession with the intent to deliver a controlled substance and criminal use of a communication facility. On Jan. 17, Cole pleaded guilty to allegations that on Nov. 5 he sold about 1.9 grams of crack cocaine and used a cell phone to set up the delivery.

    Also in court, Jacob A. Bradford, 19, of Bradford, was sentenced to one to two years in state prison with credit for 97 days of time served for charges of criminal trespassing and criminal attempted theft by unlawful taking. Bradford pleaded guilty Jan. 17 to allegations that on Oct. 29 he entered a garage next to a building on 6 Forman St., Bradford City, to commit theft.

    Richard A. Waldeck Jr., 20, of Mount Jewett, will serve four months to one year in McKean County Jail with credit for 65 days of time served and one year of consecutive probation for charges of fleeing or attempting to elude an officer and DUI-alcohol and summary charges. Among his restitution amounts is $2,771.39 to be paid back to Erie Insurance for a motor vehicle crash. At the time he was first charged, Waldeck was accused of leading police on a chase while driving under the influence of alcohol.

    Damien L. Coley, 35, of Buffalo, N.Y., pleaded guilty to charges in two cases. He’s charged in one case with conspiracy to commit simple assault and possession of marijuana, and he’s charged in the second with defiant trespassing. Assistant District Attorney Jerry Grill said that on Dec. 18, 2016, Coley possessed a small amount of marijuana for personal use, and he and several codefendants worked together to assault a man; then, on Jan. 6, 2017, Coley remained on Uni-Mart property after notice was given that he would be trespassing if he remained. He will be sentenced March 14.

    Joshua K. Green, 41, of Bradford, will serve 30 days to one year in McKean County Jail with credit for 65 days of time served and six months of consecutive probation for a charge of theft by unlawful taking and a summary charge. He will also pay $1,650 in restitution to Uni-Mart. Green pleaded guilty Jan. 17 to allegations that on June 24, he broke into a video poker machine at the Uni-Mart on Chestnut Street in Bradford, taking $1,500 in cash and causing $150 in damage.

    Shelly L. Dyne, 49, of Smethport, will serve one to five years in state prison for charges of DUI-alcohol and a summary charge.

    Vincent M. Kellogg, 28, of Shinglehouse, will serve three days to five years in McKean County Jail for charges of DUI-controlled substance and a summary charge.

    Ryan M. Stocum, 29, of Belfast, N.Y., will serve five years in the Intermediate Punishment Program for charges of DUI-alcohol and controlled substance and summary charges.

    Jeffrey W. Oxley, 63, of Bradford, will serve 10 days to 23 ½ months in McKean County Jail for a charge of simple assault. Oxley also had a hearing on a protection from abuse order violation on Thursday.

    Keven W. Curtis, 24, of Bradford, will serve nine days to one year in McKean County Jail with credit for nine days of time served, as well as one year of consecutive probation, for a charge of simple assault. On Jan. 3, Curtis pleaded guilty to allegations that on Oct. 17 he put a pillow over a female’s face during an argument and smacked the pillow.

    Stephen L. Cornelius, 30, of Bradford, will serve six days to 18 months in McKean County Jail and perform four full days of community service at the Good Growing Gardens Barn. Cornelius pleaded guilty Jan. 17 to allegations that on Oct. 10 he punched another man in the nose during a verbal altercation.

    Jasmine M. O’Toole, 38, of Bradford, pleaded no contest to one charge of criminal mischief. On Oct. 30, O’Toole damaged a door and a window worth approximately $1,775, said District Attorney Stephanie Vettenburg-Shaffer. She will be sentenced March 14.

    Kolorado O. Banks, 19, fo Bradford, will perform, in lieu of jail time, 12 full days of community service, and he will serve 18 months of probation. He is charged with receiving stolen property. On Jan. 17, Banks pleaded guilty to allegations that on Dec. 21, 2017, he received a stolen item valued at $250.

    Nikki L. Millington, 42, of Bradford, will serve 92 days to six months in McKean County Jail for charges of DUI-alcohol and a summary charge.

    Kwanejae J. Weakfall, 29, of Port Allegany, will serve three days to six months in McKean County Jail for charges of DUI-controlled substance, possession of drug paraphernalia and a summary charge.

    David R. Walters, 55, of Kane, will serve six months in the Intermediate Punishment Program and one year of concurrent probation for charges of DUI-alcohol and controlled substance, possession of drug paraphernalia and a summary charge.

    Lori S. Owens, 50, of Bradford, will serve six months in the Intermediate Punishment Program for charges of DUI-alcohol and a summary charge.

    Guy M. McCormack, 62, of Mount Jewett, will serve six months of probation for a charge of DUI-general impairment and a summary charge.
