A Kane man is facing allegations that he stole more than $20,000 in total from two Kane businesses.
Timothy R. Zampogna, 51, of 123 Bayard St., was arraigned Tuesday before District Judge David Engman on charges of 43 counts of forgery, all second-degree felonies; two counts of theft by unlawful taking, a third-degree felony and a third-degree misdemeanor; two counts of receiving stolen property, a third-degree felony and a third-degree misdemeanor; and one count of bad checks, a second-degree misdemeanor.
The criminal complaint states that between June 7, 2016, and Jan. 3, 2019, Zampogna took, one at a time, 43 checks from Flickerwood Winery. He allegedly forged the name of his mother — who is one of the owners — and cashed them at several locations.
The alleged theft was discovered when one of the winery owners reported that multiple checks were missing from QuickBooks.
Also, on Jan. 3, Zampogna tried to cash a check of his own at Save-A-Lot in Kane; the check was returned to Save-A-Lot because his account was closed, court records indicated.
According to the complaint, the checks totaled $21,048: $19,873 from Flickerwood Winery, and $1,175 from Save-A-Lot.
Zampogna was committed to McKean County Jail in lieu of $10,000 bail, and he is scheduled to appear in Central Court on Jan. 24.
Smethport man accused of assault, statutory sexual assault
A Smethport man is facing assault and statutory sexual assault charges stemming from an alleged relationship with a 14-year-old girl.
Wyatt D. Dean, 19, of Smethport, was arraigned Tuesday before District Judge William Todd on three counts of statutory sexual assault: 4-8 years older, all second-degree felonies; strangulation and simple assault, both second-degree misdemeanors; and harassment, a summary charge.
According to the criminal complaint, on Dec. 31, a 14-year-old girl contacted Port Allegany Police to say she was assaulted by Dean. On Dec. 30, he allegedly choked her, pulled her hair, head-butted, punched, pushed and grabbed her, leaving bruises.
Additionally, between mid-July and mid-December, the couple had sexual intercourse about three times, the complaint stated.
Dean is incarcerated in McKean County Jail in lieu of $20,000. He is scheduled to appear in Central Court on Jan. 24.
