SMETHPORT — A Bradford man who was convicted last month for insurance fraud stemming from a 2015 truck fire will serve time in McKean County Jail.
Thomas L. Raybuck, 35, was sentenced Thursday in McKean County Court before President Judge John Pavlock.
Raybuck was sentenced to two weeks to one year in jail with credit for one day of time served. He is to pay $18,894.25 in restitution to State Farm and complete 100 hours community service, too. Pavlock made Raybuck work release eligible.
On Aug. 22, a jury found Raybuck guilty of one charge of insurance fraud, a third-degree felony. However, he was acquitted of two charges of arson.
According to court records filed at the time Raybuck was charged, a report came into the McKean County 911 Center at 3:20 p.m. Feb. 28, 2015 for a vehicle fire at the intersection of West Songbird Road and Niles Hollow in Bradford Township.
On arrival, Bradford Township Police found a yellow Dodge Dakota pick-up truck with heavy fire damage facing east and parked off the paved part of the road. The Bradford Township Volunteer Fire Department asked for help in determining the cause of the fire from state police, who alleged the fire was caused by arson.
Raybuck was accused of filing a claim with State Farm Insurance Co. “containing false, incomplete and misleading information,” court records stated.
At the sentencing hearing, Pavlock indicated that Raybuck asserted in trial that he had gas cans in the truck because he was making homemade targets, and an accidental spark caused the fire.
An Era article published days after the fire indicated that Raybuck suffered burns and smoke inhalation in the fire. He declined treatment at the scene, but later went to Bradford Regional Medical Center and was subsequently flown to an out-of-area hospital for medical treatment.
He reportedly suffered the burns when he tried to retrieve personal belongings from the truck after the fire started.
