SMETHPORT — A Kane woman who was accused of scheming with another woman to unlawfully obtain prescription pills was found guilty of three charges at a trial this week in McKean County Court.
A jury found Kasey M. Chitester, 35, guilty of acquiring a controlled substance by fraud, conspiracy acquiring a controlled substance by fraud and conspiracy criminal use of a communication device, all felonies, District Attorney Stephanie Vettenburg-Shaffer reported.
The jury acquitted Chitester of a separate charge of conspiracy, said Shaffer.
Shaffer, who prosecuted the case, said the verdict was made after a two-day trial.
Court records filed at the time of Chitester’s arrest indicated that she schemed with Elaina M. Scharba, 41, of Kane, to fraudulently obtain pills including Tramadol and Tylenol 3.
Chitester will be sentenced at 1 p.m. Nov. 8.
Scharba pleaded guilty Feb. 13 to charges of conspiracy to acquire or obtain possession of a controlled substance through misrepresentation and acquisition by fraud. She was sentenced March 8 to a term of 30 days to 23 ½ months in McKean County Jail with credit for one day of time served.
The allegations to which Scharba pleaded guilty included assertions that she called pharmacies and pretended to be from a doctor’s office in order to obtain Tylenol 3 and lorazepam.
