SMETHPORT — A man accused in a theft from a car of more than $1,000 in items including a handgun was sentenced Thursday in McKean County Court to state prison.
Andrew F. Owens, 22, will serve six years and three months to 13 years in prison with credit for 31 days of time served for charges of possession of a firearm prohibited, theft by unlawful taking, receiving stolen property, conspiracy to commit theft by unlawful taking and conspiracy to commit receiving stolen property. He was also ordered to pay $1,384.90.
Owens was convicted of the charges at a jury trial.
The criminal complaint filed at the time of Owens’ arrested stated that around 3:50 a.m. June 26, 2016, Owens and Shawn M. Mott took items from a man’s truck while it was parked at 9 E. Washington St.
Items that were alleged at the time to be missing from the truck included a Springfield Armory XD-9 9mm handgun, two loaded magazines, a holster, a magazine carrier, shooting earmuffs, a Craftsman tool bag, a set of truck keys, a bag containing ratchet straps, a wooden axe handle, a Garmin GPS, a blue tarp and sunglasses, court records stated.
“That firearm is now out in the community,” Assistant District Attorney Ashley Shade noted of the handgun that was stolen. “It was never recovered.”
Also in court, Alexander J. Hayes, 24, of Bradford, was sentenced to a term of one to two years in state prison for charges of possession with the intent to deliver a controlled substance and criminal use of a communication facility. Hayes pleaded guilty March 8 to allegations that on March 23, 2017, he used a communication facility to set up a drug delivery, then he delivered .76 grams of crack cocaine while under the observation of the McKean County Drug Task Force.
Robert E. Stuckey, 51, of Olean, N.Y., will serve six to 23 months in McKean County Jail for charges of possession with the intent to deliver a controlled substance, resisting arrest and a summary charge. On Feb. 8, Stuckey pleaded guilty to allegations that on Aug. 18, he possessed about one pound of marijuana with the intent to deliver it, and, when police tried to take him into custody, he resisted arrest, requiring an officer to deploy a Taser.
Amber N. Leschner, 28, of Mount Jewett, will serve two days to one year in McKean County Jail for charges of forgery and theft by deception. Leschner, who was found guilty at a jury trial, has already paid $160 in restitution. According to court records filed at the time of Leschner’s arrest, once in June and once in July, she wrote out checks to herself from an employer’s account. She was accused of forging her employer’s name and cashing the checks at a Kane credit union for a total amount of $160.
Jeffrey W. Letson, 54, of Bradford, will serve one year of probation for a charge of theft of property that is lost, mislaid or delivered. Letson pleaded guilty Feb. 8 to allegations that on Oct. 5, he took a wallet containing $113.
Crystal D. Carr, 36, of Bradford, will serve one year of probation for a charge of false reports to law enforcement. On Feb. 8, Carr pleaded guilty to allegations that on Nov. 20, she provided false information to law enforcement officials in order to incriminate another person.
Danyelle L. Cabisca, 25, of Bradford, will serve one year of probation for a charge of retail theft. Cabisca pleaded guilty Feb. 8 to allegations that on June 11, she took $11.51 in merchandise from Country Fair.
Dennis L. Bashline Jr., 33, of Port Allegany, will serve six months in the Intermediate Punishment Program for charges of DUI-controlled substance and a summary charge.
Edward E. Gadley, 58, of Kane, will serve six months in the Intermediate Punishment Program for a charge of DUI.
