SMETHPORT — An Olean, N.Y., man has been jailed on allegations he was carrying about a pound of marijuana under the spare tire of his vehicle in Liberty Township.
Robert E. Stuckey, 51, of 307 S. 8th St., was arraigned Friday before District Judge William Todd on charges of possession with the intent to deliver a controlled substance, a felony; resisting arrest, a second-degree misdemeanor; possession of a controlled substance, possession of drug paraphernalia and driving under the influence of a controlled substance, all misdemeanors; and summary charges of duties at a stop sign and turning movements and required signals, court records stated.
According to court records, at 9:17 a.m. Friday, a trooper with the State Police Bureau of Emergency and Special Operations Canine watched a minivan that was traveling west on Wilson Avenue turn onto Route 155 without a turn signal and without coming to a complete stop at the stop sign. The trooper pulled over the minivan, which was allegedly driven by Stuckey.
“Upon making contact with the vehicle, I could smell the odor of raw marijuana emanating from inside the vehicle,” the trooper stated in the affidavit of probable cause.
The trooper had Stuckey get out of the minivan. He gave Stuckey a pat down and found a “large sum of U.S. currency” from his front pants pocket, court records stated.
When the trooper searched Stuckey’s name in records databases, he allegedly found that Stuckey had drug-related violations, and he told Stuckey, who showed signs of impairment, that he was going to search his vehicle.
Court records indicated that Stuckey resisted when the trooper tried to arrest him, which caused the trooper to have to use a Taser when trying to handcuff him; two more officers then arrived and helped handcuff him.
Stuckey told officers, “I want to come clean, the marijuana is under the spare tire in the vehicle,” court records stated.
Police found about one pound of marijuana and drug paraphernalia, and Stuckey was then taken to Bradford Regional Medical Center for blood draw, according to court records.
He was incarcerated in McKean County Jail in lieu of $50,000, and he is scheduled to appear in Central Court on Thursday.
