ERIE — Two people have been indicted for separate alleged incidents at the Federal Correctional Institution-McKean, according to acting U.S. Attorney Soo C. Song.
Song reported that Rogelio Muniz-Valdez, 41, and Malinda Penezich, 47, are facing charges.
Valdez, an inmate at FCI-McKean, was indicted by a federal grand jury on a charge of assaulting a federal officer, Song stated.
The law provides a maximum sentence of eight years in prison and/or a fine of $250,000 if Valdez is convicted.
Meanwhile, Penezich of 154 Maryland St. NW, Warren, Ohio, was indicted on a charge of providing contraband in prison for allegations that on Nov. 27, she provided marijuana to an inmate of FCI-McKean, according to Song.
The law provides a maximum of five years in prison and/or a fine of $250,000 in Penezich’s case.
If either defendant is convicted, the actual sentence will be based upon the seriousness of the offense and the person’s prior criminal history.
Assistant U.S. Attorney Christian A. Trabold is prosecuting both cases on behalf of the government.
Officers of FCI-McKean investigated both alleged incidents, and Pennsylvania State Police were also involved in the investigation into Penezich’s case.
