Smethport man sentenced for drug delivery

SMETHPORT — A Smethport man was sentenced Thursday in McKean County Court to a term in state prison for a drug delivery.

Mark D. Burlingame, 34, will serve one to two years in state prison with credit for one day of time served for charges of possession with the intent to deliver a controlled substance and criminal use of a communication facility.

On May 13, 2016, Burlingame delivered two morphine tablets to a confidential informant with the McKean County Drug Task Force and used a telephone to facilitate the sale, District Attorney Stephanie Vettenburg-Shaffer said.

Also in court, Nicholas McNeil, 22, of Bradford, pleaded guilty to charges in two cases. He’s charged in one case with terroristic threats and in the second with criminal trespassing, simple assault and a summary charge. According to Shaffer, on Dec. 18, McNeil broke the entryway of 42 N. Kendall Ave. when he burst through while under the influence of alcohol, and he tried to hurt a woman. Then, on March 26, he threatened to shoot two people. He will be sentenced May 25.

Levi T. Haberberger of Mount Jewett and Jacob J. Bailey, 21, of Kane, each pleaded guilty to charges of theft by unlawful taking, criminal mischief and a summary charge. On Jan. 2, Haberberger and Bailey took items belonging to Kane Area High School, including a duffle bag, two pairs of sneakers and various shop tools worth $1,425.90, and they caused $1,331.09 in damage to two windows and two Dell computer monitors, according Assistant District Attorney Ashley Shade. They will be sentenced May 25.

Ryan C. Bodecker, 26, of Bradford, pleaded guilty to a charge of resisting arrest. On Oct. 31, Bodecker pulled away from a Bradford City Police officer who was arresting him, and started to flee on foot, said Assistant District Attorney Sean Barrett. He will serve six to 18 months in state prison with credit for 52 days of time served.

Jordan M. Reams, 19, of Bradford, pleaded guilty to charges of burglary and theft by unlawful taking. According to Barrett, between April 8-9, Reams was an accomplice to Michael Payne in taking a radio speaker and record player valued at $20 from the Farm Family Restaurant. Reams will be sentenced June 8. Meanwhile, Payne has not been convicted of any charges in a criminal case against him, which is still pending. A last day to plea conference for Payne is scheduled for July 13.

Matthew E. Kline, 29, of Bradford, pleaded guilty to charges of stalking, loitering and prowling at night time, possession of clonazepam and a summary charge. Shade said that on Oct. 12, Kline was prowling on the property of 419 High St., Bradford, looking in windows, trying to get in and communicating with the victim by cell phone, causing her distress. He will be sentenced June 8.

Mary L. Silvis, 52, of Port Allegany, will serve 120 days to 23½ months in McKean County Jail with credit for 31 days of time served for a charge of access device fraud.

Andrew J. Ludwig, 29, of Bradford, pleaded guilty to a charge of false identification to a law enforcement officer and a summary charge. On Feb. 6, at the Chestnut Street minimart, Ludwig — who was under the influence of a controlled substance — provided his brother’s name to a law enforcement official, pretending it was his own, according to Shaffer. He will be sentenced June 8.

John Lekas, 30, of Bradford, pleaded guilty to a charge of criminal mischief. Shaffer explained that on April 1, Lekas damaged the back door of a woman’s home, causing $650 in damage. He will be sentenced June 8.

Gene V. Meacham Jr., 28, of Bradford, pleaded guilty to charges of possession of a small amount of marijuana and possession of drug paraphernalia. He will be sentenced June 28.

Joseph R. Ferranto, 18, of Smethport, was accepted into the Accelerated Rehabilitative Disposition Program for possession of drug paraphernalia.
