SMETHPORT — A Kane man is facing drug-related charges after he was found in possession of marijuana that was packaged for sale.
Frank Anthony Nicolazzo, 29, of 6002 Route 66, was arraigned before District Judge William Todd on charges of possession with the intent to deliver a controlled substance, a felony; and possession of drug paraphernalia, a misdemeanor, court records stated.
According to court records, at 12:59 a.m. Sunday, a Kane Borough police officer watched Nicolazzo wave a lighter around inside a pick-up truck that was parked in the 300 block of Welsh Street in front of the Buck Horn Hotel. It appeared to the officer that Nicolazzo was lighting a marijuana bowl in the passenger side.
The officer approached the truck and asked the two people inside to exit; they did, and they put up the windows and locked the door. The officer pointed out a bowl that he believed he could see sitting on the floor passenger side and said he would need to search the truck.
“The driver hesitantly said no,” court records read.
The officer called state police to assist, and a search was completed. Officers allegedly found a marijuana pipe, a scale and individually wrapped baggies containing a total of 52.6 grams of marijuana, court records stated.
Court records did not give the driver’s identity, and there is no indication that charges were filed against anyone other than Nicolazzo.
Nicolazzo was committed to McKean County Jail in lieu of $10,000 bail. He is scheduled to appear in Central Court on Thursday.
