Bradford man to serve state prison term for four cases

SMETHPORT — A Bradford man was sentenced Thursday in McKean County Court to a term in state prison for charges in four separate criminal cases.

David D. Mihalko, 36, of Bradford, will serve 21 to 42 months in state prison with credit for 151 days of time served.

Mihalko is charged in two cases with simple assault, one case with theft by unlawful taking and in the last case with fleeing or attempting to elude an officer, driving under the influence of a controlled substance and summary charges.

Mihalko pleaded guilty April 6 to allegations that on Dec. 14, he fled from law enforcement officials who were pursuing him while he was under the influence of a controlled substance, going through a stop sign, driving faster than was safe. On Sept. 3, he entered into a mutual fight with a woman, and on Dec. 2, he injured another woman. Finally, on July 1, 2015, he took a class ring, coins and a safe deposit key worth a total of $850.

Also in court, Juan R. Saenz-Morales Jr., 34, of Bradford, will serve six months to two years in state prison with credit for 10 days of time served for charges of simple assault and summary charges. Morales was found guilty by a jury on March 27. President Judge John Pavlock said on Thursday that Morales had assaulted a male while he was “very intoxicated,” then the next day chased the same male down the street and assaulted him again.

Alexandra C.R. Farnsworth, 24, of Bradford, will serve 46 days to 18 months in McKean County Jail with credit for 46 days of time served for charges of hindering apprehension/prosecution in two cases.

Farnsworth pleaded guilty March 23 to allegations that on Jan. 17, she hid from police a 17-year-old juvenile who absconded from a detention center and was wanted on first-degree felony charges; then, on March 8, she concealed from police a person who was wanted on state parole.

Samuel P. Carr, 23, of Smethport, will serve five years in the Intermediate Punishment Program for charges of driving under the influence of a controlled substance and summary charge.

Jolean M. Cottone, 32, of Allegany, N.Y., was sentenced to three days to five years of incarceration for charges of driving under the influence of alcohol and recklessly endangering another person and a summary charge. Cottone, who has no prior criminal record, will serve her minimum three incarceration days by doing three community service days at the Poor Farm barn.

Adrian K. Smith II, 39, of Kane, will serve 20 days to 18 months in McKean County Jail with credit for seven days of time served for charges of driving under the influence of alcohol or a controlled substance, resisting arrest and a summary charge.

James D. Felmlee, 51, of Bradford, will serve 15 days to six months in McKean County Jail with credit for one day of time served for charges of driving under the influence of alcohol and summary charges.

Jeffrey M. Switzer, 29, of Rew, and Jason C. Keck, 37, of Bradford, will each serve six months in the Intermediate Punishment Program for charges of driving under the influence of alcohol and summary charges.

James A. Teeter, 50, of Bradford, will serve one year of probation for a charge of statement under penalty.

Kyle K. Keller, 30, of Bradford, will serve 90 days of probation for a summary charge of harassment.
