    Port Allegany man sentenced in county court for 10th DUI

    SMETHPORT— A Port Allegany man was sentenced on Thursday in McKean County Court for his 10th DUI case.

    Joseph L. Chludzinski Sr., 72, pleaded guilty to a charge of driving under the influence of alcohol and summary charges. He will serve one to two years in state prison.

    Assistant District Attorney Sean Barrett said on April 24, Chludzinski, who was under the influence of alcohol, failed to keep in the right lane and struck a parked car. President Judge John Pavlock noted prior to giving his sentence order how many DUIs Chludzinski had, with this one being number 10.

    Zachary D. Foust, 23, of Bolivar, N.Y., will serve 60 days to 23 ½ months in McKean County Jail with credit for five days of time served on charges of receiving stolen property, criminal trespassing and theft from a motor vehicle. He pleaded guilty Oct. 13 to allegations that between April 27 and 29, he received $5,420 in stolen equipment — some of it stolen out of a vehicle — and he entered 649 Lynch Hollow Road in Ceres Township without permission.

    Zachary P. Harter, 31, of Rochester, Pa., will serve nine to 18 months in McKean County Jail with 64 days of credit for time served on a charge of possession with the intent to deliver a controlled substance. When Harter was first arrested, he faced allegations he possessed with the intent to deliver crack cocaine.

    Keian Schweigart, 18, of Kane, will serve nine to 18 months in McKean County Jail with credit for 103 days of time served and six months of probation on a charge of receiving stolen property. Pavlock noted that Schweigart had stolen his grandmother’s .38 special pink lady revolver.

    Renee E. Seger, 20, of Roulette, will serve 100 days to 18 months in McKean County Jail on a charge of conspiracy to commit burglary. Seger pleaded guilty Nov. 3 to allegations that on Dec. 3, 2015, she agreed with another female that one of them would commit burglary at a home that was not occupied at the time of the incident.

    Roger A. Akins, 31, of Kane will serve 30 days to 18 months in McKean County Jail with credit for 30 days of time served on a charge of simple assault. On Nov. 3, he pleaded guilty to allegations he struck a woman in the head and upper body.

    Kenneth R. Bell, 20, of Bradford, will serve four to 12 months in McKean County Jail with credit for 94 days of time served and 12 months of probation, and he will pay $1,629 in restitution on a charge of receiving stolen property. Bell pleaded guilty Nov. 3 to allegations he received a stolen vehicle.

    Russell S. Ferraro, 36, of Kane, will serve 44 days to 12 months in McKean County Jail with credit for 44 days of time served on a charge of defiant trespass and a summary charge. Ferraro pleaded guilty Nov. 17 to allegations that on Sept. 16, he entered the residence of Josh Bodistow, failing to leave even though he was told not to be there. Meanwhile, Bodistow is scheduled for a last day to plea conference on Jan. 5, 2017, on allegations he assaulted Ferraro with a crowbar on Sept. 16.

    Stephanie M. Tyler, 18, of Bradford, will serve 12 months of probation on a charge of terroristic threats. She pleaded guilty Nov. 3 to allegations she wrote a note to nursing staff at Bradford Regional Medical Center saying she was going to bomb the building and shoot the windows out with a gun.

    Kathleen M. Miller, 31, of Bradford, will serve 12 months of probation on a charge of theft by unlawful taking. Pavlock said Miller took $100 from Country Fair while she was employed there.

    Kyle R. South, 25, of Cyclone, will serve 12 months of probation on a charge of possession of a controlled substance and a summary charge.

    George H.L. Cabisca, 37, of Rew, will serve six months of probation on a charge of driving under the influence of alcohol and summary charges.

    Noah P. Gullifer, 24, of Kane will serve six months of probation on a charge of driving under the influence of alcohol and numerous summary charges.

    Donald A. Stewart Jr., 61, of Kane, pleaded guilty to a charge of driving under the influence of alcohol and a summary charge. He will serve six months of probation.

    Misty S. McCullen, 40, of Bradford, will serve six months of probation on a charge of possession of drug paraphernalia.
