Little Genesee, N.Y., man pleads no contest to indecent assault

 

SMETHPORT — A Little Genesee, N.Y., man pleaded no contest Thursday to allegations he had indecent contact with a 12-year-old girl and a 13-year-old girl.

James A. Montgomery, 70, appeared in McKean County Court before President Judge John Pavlock to enter his plea.

Montgomery first indicated he planned to plead guilty, but when Assistant District Attorney Ashley Shade read aloud the allegations — that he touched the girls, kissed them on the neck and told them he loved them and wished they were older — he disagreed with her description of the incident.

Montgomery agreed he kissed the girls’ necks but said he didn’t say anything “derogatory” to them.

A recess was held in the hearing, during which Pavlock handled other criminal matters. When the hearing resumed, a no contest plea agreement was offered by the District Attorney’s Office, which Montgomery accepted.

Montgomery will have to undergo a Sexually Violent Predator evaluation before his sentencing date on Jan. 21, 2016. He remains free on $45,000 unsecured bail.
