A Kane man is in jail after he allegedly pointed a loaded gun at a friend while a group was drinking wine together outside Tuesday night.
Perry Lynn Bomboy, 54, of 136 Fraley St., Apt. 2, was arraigned on Wednesday before Magisterial District Judge David Engman on charges of aggravated assault, a second-degree felony; possession with the intent to deliver a controlled substance, a felony; terroristic threats, a first-degree misdemeanor; recklessly endangering another person, a second-degree misdemeanor; possession of a controlled substance, a misdemeanor, court records stated.
Court records said at 9:43 p.m., Bomboy was part of a group of four men “drinking wine and having a good time” in the parking area behind 136 Fraley St. One man, George Sirianni, decided to go to the store in his truck.
Court records stated that as Sirianni was leaving, he drove through the parking area in close proximity to where Bomboy sat, and witnesses said Bomboy “reached out and pushed the front left corner of the truck” — which caused him to fall backwards on the chair, breaking it. The other men laughed, which made Bomboy angry.
Court records said Bomboy went to his apartment and returned with a shotgun. Another man, Scott Dunkle, approached Bomboy to have him put the gun down, and Bomboy allegedly pointed the gun at Dunkle’s chest.
He pointed the gun at Dunkle after “’racking the slide’ charging the weapon and putting a live round into the chamber,” court records read.
Dunkle told him “he better use it or put it away,” and Bomboy went back to his apartment. The group called the McKean County 911 Center, and Kane Borough Police and Kane-based state police responded.
McKean County dispatch contacted Bomboy, who went outside unarmed to meet police. He complied with orders to get on the ground and allowed police to handcuff him.
Bomboy told police someone hit him with the truck, “which caused him to fall backwards and land on his butt,” and he wanted to scare them because they made him mad by laughing, court records stated.
Bombay gave consent to police to search his apartment for the gun and ammunition. There, police found, in addition to the shotgun, a small marijuana growing operation on the window sill, court records stated. When Bombay said, “I guess you’re going to take my weed, too;” police confirmed they would.
Police also seized a rifle, ammunition for both guns two containers with eight suspected marijuana plants and drug paraphernalia, according to court records.
Bomboy was committed to McKean County Jail in Smethport in lieu of $50,000 bail. He is scheduled to appear in Central Court on July 2.
