An Allegany, N.Y., man has been charged with sexually assaulting
a teenage girl early Sunday morning on an activities bus for Open
Arms Community Church.
Terry W. Mitchell, 52, of 7 Williams St., is charged with
corruption of minors, a first-degree misdemeanor; and indecent
assault and unlawful contact with a minor, both second-degree
misdemeanors.
According to court records, a 15-year-old female reported to
Foster Township Police that she had gone on a bus trip with the
Open Arms Church to Allegany for a church function, leaving at 8:15
p.m. Saturday from Foster Township. Mitchell was the bus
driver.
On the way back from the event at 11:45 p.m., when the victim
was the only person on the bus with Mitchell, he stopped the bus at
a convenience store and bought her a bottle of chocolate milk, the
records read. They remained in the parking lot talking for a period
of time before Mitchell drove the bus to the parking lot of the
former Kmart store around 2 a.m. Sunday.
Then, the records read, Mitchell asked the girl to go to the
back of the bus – where there was no exit – made her lay down, took
her pants off and touched her inappropriately.
According to the records, Mitchell told the girl not to say
anything and to tell her parents she got back late because he drove
slowly.
The girl told her parents, who called the McKean County 911
Center, which contacted the police. Later Sunday morning, Mitchell
was arrested. He told police that he had been counseling the girl
during their time alone on the bus, the records read.
Mitchell was arraigned before on call Magisterial District Judge
Richard Luther. He was released on $5,000 cash bail. A preliminary
hearing was set for Nov. 15 in front of Luther.
