Nersinger and Nelson cases will be heard at same time

The cases of two women accused of lying that they heard Becky
Lucrezi Olson admit that she, and not Timothy Williams, shot a Kane
Borough Police officer in 1999, will be heard at the same time.

Marian Kay Nersinger of Holley, N.Y., and Michelle Nelson of
Scio, N.Y., are both charged with one count of perjury, a
third-degree felony. The two allegedly lied during separate Post
Conviction hearings for convicted cop-killer Timothy Williams.

Nersinger and Nelson testified that they heard Becky Lucrezi
Olson, a passenger in Williams’s car, admit that she shot Kane
Borough Police Officer Steve Jerman. Williams was convicted of
third-degree murder in the death of Jerman, who died Feb. 20,
1999.

McKean County Judge John Yoder ruled Thursday that the two cases
will be heard at the same time. The trial is set to begin May
1.

In his order, Yoder ruled that since the motion was unopposed,
he would consolidate the cases as long as there is no request for
continuance because more time is required to prepare for trial
because of the consolidation.

During a hearing Wednesday in McKean County Court, defense
attorney Sam Stretton argued it would be “foolish to try them as
two separate cases.”

Stretton represents Williams as well as Nersinger and
Nelson.

There are several other issues that need to be decided after
Wednesday’s hearing. They include whether anyone who was not
present when the admissions were allegedly heard can testify, if
Nersinger can testify how her cancer treatment has affected her
memory.

The two sides will also decide whether or not a jury from McKean
County will be able to hear the cases.

During voir dire, when the jury pool is questioned, they will
decide if there was too much pre-trial publicity for a jury from
McKean County to hear the case.

Several witnesses have come forward who claim to have heard
Lucrezi say she shot Jerman.

Lucrezi, however, has claimed that she was not the shooter, but
rather, was in the back seat of the car with another passenger,
Matthew Seeley.

Williams was critically injured and claims to not remember what
happened.
