ST. MARYS — A Fox Township man is charged with indecent assault and possessing child pornography after allegedly forcing a minor under the age of 10 to perform sex acts on him and photographing the encounters.

Dennis L. Fischer, 43, of 98 Sandberg St., Dagus Mines, was charged with 27 related counts, 22 of them felonies, in St. Marys District Court on Tuesday. He remains confined to the Elk County Prison in Ridgway on $50,000 cash bail.

According to an affidavit of probable cause released in the case, Fischer allegedly forced the female victim to perform sex acts at a Kersey residence on at least five occasions between September 2014 and March 2015.

That month, the child and her mother are said to have brought the accusations to state police in Kane.

In a subsequent interview with state troopers in Ridgway, Fischer was asked if the child may have been confused about the nature of their encounters.

“I don’t know, maybe,” police quote him as saying.

Asked about specific allegations, Fischer is said to have maintained his innocence while in the same breath admitting it remained a possibility.

“When asked if (the victim) performed oral sex on him, he replied, ‘Hell no, not that I’m aware of,” the affidavit reads. “Asked if it was possible, he replied, “I don’t know, anything is possible.’”

The interview would end without criminal charges being filed and months would go by before the child’s mother returned to state police on Saturday, this time with alleged photographic evidence documenting the illicit encounters.

Both Fischer and the child are said to be visible in the photos, allegedly recovered from the victim’s camera, helping to solidify the charges filed against him on Tuesday, according to police.

They include five counts each of involuntary deviate sexual intercourse with a child, a first-degree felony; aggravated indecent assault of a child, a first-degree felony; aggravated indecent assault of a child less than 13 years of age, a second-degree felony; corruption of minors, a third-degree felony; and indecent assault of a person less than 13 years of age, a first-degree misdemeanor.

Fischer is also facing single counts of photographing a sex act with a child, a second-degree felony; and possessing child pornography, a third-degree felony.

He is confined to Elk County Prison pending a preliminary hearing at 9:15 a.m. on July 28 in St. Marys District Court.

Online court records did not list a defense attorney in the case as of Wednesday.
